dadCAM: Terms & Conditions

Welcome to dadCAM! By downloading, accessing, or utilizing our application (the "App"), you hereby acknowledge and agree to comply with and be bound by the following Terms and Conditions (the "Terms"). If you do not agree with any portion of these Terms, please refrain from using our App.

1. Acceptance of Terms

By accessing, downloading, installing, or using the dadCAM mobile application (“App”), you acknowledge and agree to be legally bound by these Terms and Conditions, together with our Privacy Policy, incorporated herein by reference.

Your use of the App constitutes a binding agreement between you and dadCAM. If you do not agree to these Terms, you must immediately discontinue use of the App.

2. Eligibility

The App is intended for individuals who are capable of forming legally binding contracts under applicable law. Users under the age of 13 must obtain verifiable parental or legal guardian consent in accordance with applicable privacy laws. By using the App, you represent that you are of legal age in your jurisdiction or have obtained the necessary consent to use the App.

3. License to Use

Grant of License:

Subject to your compliance with these Terms, dadCAM hereby grants you a limited, non-exclusive, non-transferable, revocable license to use the App on compatible devices for personal, non-commercial purposes only.

Restrictions:

You shall not, under any circumstances:

Modify, alter, adapt, or create derivative works from the App;
Use the App for commercial purposes without the express written consent of dadCAM;
Distribute, sell, lease, rent, sublicense, or otherwise transfer rights to the App;
Decompile, reverse-engineer, or attempt to extract the source code of the App, except as expressly permitted by law.

4. User-Generated Content

Responsibility for Content:

By uploading, posting, or transmitting any content (including but not limited to photos, videos, or textual content) via the dadCAM App, you represent and warrant that you possess all necessary rights, licenses, or consents to lawfully share said content. You agree to be solely responsible for any liability arising from your content.

License Grant:

By submitting content through the App, you hereby grant dadCAM a worldwide, royalty-free, non-exclusive, irrevocable, transferable, and sublicensable right and license to use, reproduce, distribute, modify, adapt, publicly display, and perform such content for purposes including, but not limited to, operating, marketing, and promoting the App.

Content Ownership:

You retain ownership of all content you create or modify using dadCAM App; however, you acknowledge and agree that dadCAM shall retain a perpetual license to use such content as necessary for the proper functioning of the App, including marketing and promotional activities.d. Content Review: dadCAM does not pre-screen content; however, we reserve the right, at our sole discretion, to remove, block, or restrict access to content that violates these Terms or is otherwise deemed inappropriate or illegal.

5. Content Removal Requests

T o request removal of content you have uploaded, please contact us at help@dadcam.art. We will make commercially reasonable efforts to remove the content, subject to any legal obligations or technical constraints.

6. Prohibited Conduct

You agree not to engage in any conduct that is unlawful, harmful, or disruptive to the operation of the App, including but not limited to:

Using the App for fraudulent purposes or any unlawful activity;
Uploading, posting, or transmitting content that infringes intellectual property rights, is defamatory, harassing, obscene, or otherwise objectionable;
Misrepresenting your identity or affiliation with any person or entity;
Attempting to gain unauthorized access to the App or its related networks or systems.

7. Intellectual Property Rights

Ownership of intellectual property:

All intellectual property rights in the App, including but not limited to its software, design, logos, graphics, and content, are and shall remain the sole property of dadCAM or its licensors. No rights, title, or interest in any intellectual property is transferred to you through the use of the App.

Trademark Use:

You may not use any trademarks, trade names, logos, or branding of dadCAM without prior written authorization, except as expressly permitted under these Terms.

8. Disclaimers of Warranties:

The dadCAM App is provided on an “as-is” and “as-available” basis. dadCAM disclaims all warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. dadCAM makes no representations or guarantees regarding the accuracy, reliability, or availability of the App and does not warrant that the App will be free of interruptions, errors, or security vulnerabilities.

9. Limitation of Liability

To the fullest extent permitted by law, dadCAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or in connection with your use of the App, even if advised of the possibility of such damages. In any event, dadCAM’s total cumulative liability under these Terms shall not exceed the amount you paid for use of the App, if any.

10. Indemnification

You agree to indemnify, defend, and hold harmless dadCAM, its officers, directors, employees, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your use of the App, or your violation of any rights of a third party.

11. Termination

dadCAM reserves the right to terminate, suspend, or restrict your access to the App at its sole discretion, without notice or liability, if it believes you have violated these Terms or engaged in any activity that could harm dadCAM, its users, or third parties.

12. Amendments to the Terms

dadCAM reserves the right to modify, update, or amend these Terms at any time. Any changes will be posted within the App and shall become effective immediately upon such posting. Your continued use of the App following the posting of any changes constitutes acceptance of the revised Terms. It is your responsibility to review the Terms regularly.

13. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be exclusively resolved through binding arbitration conducted in accordance with the rules of the UAE.

14. Miscellaneous

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be enforceable to the fullest extent permitted by law.

Entire Agreement:

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and dadCAM regarding the use of the App and supersede all prior agreements or understandings, whether written or oral

Waiver:

Any failure by dadCAM to enforce any provision of these Terms shall not be deemed a waiver of future enforcement of that provision or any other provision

dadCAM: Privacy Policy

This Privacy Policy ("Policy") describes how dadCAM ("we," "us," or "our") collects, uses, discloses, and protects your information when you use our mobile application (the "App").
